Apportionment of the rent-charge in lieu of Tithes in the Parish of Chiddingly, in the County of Sussex.

Whereas an agreement for the commutation of tithes in the parish of Chiddingly, in the county of Sussex, was, on the seventh day of October, in the year One thousand Eight Hundred and Thirty-nine, confirmed by the Tithe Commissioners for England and Wales, of which Agreement, with the Schedule thereunto annexed, the following is a copy:-

 Articles of Agreement for the commutation of the Tithes of the parish of Chiddingly, in the count of Sussex, in pursuance of the act for the commutation of Tithes in England and Wales, made and executed at a meeting duly called and holden in the said parish, and adjourned form time to time, and holden by adjournment, on the sixth day of May, in the year of our Lord One Thousand Eight Hundred and Thirty Nine, by and between the several persons, Owners of land within the said parish, by whom or by whose agents duly authorised in that behalf these presents are executed, and the interest of which landowners in the lands of the said Parish is not less than Two-thirds of the lands therein subject to Tithes, of the one part; and Augustus Elliot Fuller, of Rosehill, in the Parish of Brightling, in the said county, Esquire, Impropriator of all tithes of corn, Grain,and Hay, of the said Parish of Chiddingly, and the Reverend Whitworth Russell, Vicar of the said Parish of Chiddingly, and as such Owner of all the Tithes thereof (except tithes of Corn, Grain, and Hay), of the other part.

            IT IS HEREBY AGREED, That the annual sum of Five Hundred  and fifty pounds, by way of rent-charge, (subject to the provisions of the said act,) shall be paid to the s aid AUGUSTUS ELIOTT FULLER, and to his heirs and assigns, instead of all the Rectorial Tithes of the Lands of the said Parish subject to Tithes, except the contingent additional Rent-charges which may accrue in respect of the Glebes hereinafter provided for.

            AND that the further sum of Five Pounds shall be payable to the said AUGUSTUS ELLIOT FULLER, his heirs and assigns, in respect of the Rectorial Tithe on the Rectorial Glebe Lands of the said Impropriate Rectory, when they are not in the manurance or occupation of the Impropriate Rectors themselves.

            AND the further sum of Twelve Shillings shall be payable to the said AUGUSTUS ELLIOT FULLER, his heirs and assigns, by way of rent charge, in respect of Rectorial Tithe on the Glebe Lands of the said vicarage when they are not in the manurance or occupation of the vicar for the time being.

            AND IT IS FURTHER AGREED, That the Annual sum of Two Hundred and Fifty Two Pounds and Three Shillings, by way of rent charge, subject to the provisions of the said Act, and also subject to the variation in respect of rent charge upon Hop-grounds hereinafter mentioned and provided for, shall be paid to the said WHITWORTH RUSSELL, as vicar of the said Parish, and to his Successors, instead of all the Vicarial Tithes of the Lands of the said Parish subject to Tithes, except the contingent additional Rent-charge which may accrue in respect of the Glebe Lands hereinafter provided for.

            AND FURTHER, that there shall be payable to the said WHITWORTH RUSSELL, as Vicar of the said Parish, and to his successors, the Annual Sum of Four Pounds and Five Shillings by way of Rent-charge in respect of the Vicarial Tithe on the Glebe Lands of the said Impropriate Rectory, when they are not in the manurance of the Impropriate Rectors themselves, and which Sum of Four Pounds and Five Shillings includes the Sum agreed to be paid in respect of such part of the Glebe of the said Impropriate Rectory as is now cultivated with Hops, the quantity whereof is hereby agreed to be and shall be considered to be Three Acres and One Rood, the extraordinary Rent-charge in respect of which shall be fixed as hereinafter provided with respect to other Hop-grounds within the said Parish.

            AND there shall be likewise payable to the said Vicar, and his successors, the Annual sum of Ten Shillings by way of Rent-charge in respect of the Vicarial Tithe on the Glebe Lands of the said Vicarage, when they are not in the manurance or occupation of the Vicar for the time being.

            AND IT IS ALSO AGREED, that the said several Rent-charges shall be paid and received, not only instead of all Tithes, but instead of all the Lands of the said Parish, or the produce thereof, a summary description of which Lands is contained in the schedule hereunto annexed.

            And whereas THE SAID Rent-charge of Two Hundred and Fifty Two Pounds and Three Shillings which it is hereinbefore agreed shall be paid to the said Vicar, includes the sum agreed for in Commutation of the Vicarial Tithes of all those Lands in the said Parish which are at present cultivated as Hop-grounds, (except the contingent additional extraordinary Charge for Hops on the Rectorial Glebe hereinbefore provided for), the quantity whereof it is hereby agreed is and shall now be considered to be Seventy Acres and One Rood.

            And it is hereby further agreed,  That the Tithe Commissioners for England and Wales shall fix the Rate per Imperial Acre, which shall be the extraordinary charge payable in respect of Lands in the said Parish, cultivated as Hop-grounds and that if any such Lands shall hereafter cease to be cultivated as Hop-grounds, and shall be restored to an ordinary course of husbandry, they shall cease to pay such extraordinary Charge; and that the said Annual Vicarial Rent-charge of Two Hundred and Fifty-two Pounds and Three Shillings shall be to that extent reduced; and on the other hand, if any Lands within the Parish shall, after the date of this agreement, be newly cultivated as Hop-grounds, the same Rent-charge shall be to that extent increased.

            AND LASTLY, IT IS HEREBY AGREED, that the Lands included in this agreement shall be discharged from the payment of Tithes, and that the Rent-charge shall commence from the First day of October next.

            IN WITNESS  whereof the said parties to those presents, or their respective Agents thereunto duly authorised in their names and on their behalf, have to these presents subscribed and set their respective Hands and Seals at the time and place above-mentioned.


SCHEDULE TO THE ABOVE ARTICLES OF AGREEMENT

            THE whole Parish of CHIDDINGLY aforesaid, contains, by estimation, Four Thousand and Ninety-five Acres and One Rood.

            THE whole quantity of the Lands of the said Parish which are subject to the payment of both Rectorial and Vicarial Tithes, (excepting the Glebe), is, by estimation Three Thousand and Eighty-four Acres.

            THE whole quantity of Land subject to both Rectorial and Vicarial Tithes within the said Parish which is cultivated as Arable Land, is, by estimation, One Thousand Nine Hundred and Seventy Acres and Two Roods.

            THE whole quantity of Land subject to both Rectorial and Vicarial Tithes within the said Parish, which is cultivated as Meadow Land, is, by estimation, Three Hundred and Seventy Acres and Two Roods.

            THE whole quantity of Land subject to both Rectorial and Vicarial Tithes within the said Parish, which is cultivated as Pasture Land, is, by estimation, Six Hundred and Thirty-one Acres and Three Roods.

            THE whole quantity of Land subject to both Rectorial and Vicarial Tithes within the said Parish, which is cultivated as Hop-ground, is, by estimation, Sixty Acres and Two Roods.

            THE whole quantity  of Land subject to both Rectorial and Vicarial Tithes within the said Parish, which is cultivated as Garden-ground, is, by estimation, Forty Six Acres and Three Roods.

            THE whole quantity of Land within the said Parish, which is cultivated as Wood Land, is, by estimation, Seven Hundred and Sixty Acres and Three Roods, and the same is Tithe-free so long as it continues as Wood Land, being within the Weald.

            THE Glebe lands belonging to the Impropriate Rectory, which, if not in the hands of the owner, would be subject to Tithes amount, by estimation, to Thirty-four Acres and Two Roods.

            THE Glebe Lands belonging to the Vicarage, which, if not in the hands of the Owner, would be subject to Tithes, amount, by estimation, to Seven Acres.

            THE undermentioned Lands of the said Parish, are subject to Vicarial Tithes, but are, and have been from time immemorial, exempt from payment of any kind of Rectorial Tithe, that is to say,--

            ALL that farm lying within the said Parish, called the Stream Farm, and of which Robert Reeves of Chiddingly aforesaid, Farmer, is the owner or reputed owner, and which is now in the occupation of the said Robert Reeves, his tenant or assigns, and contains, by estimation, as follows:-

            AND WHEREAS a separate award, by way of Supplement to the foregoing Parochial Agreement, was on the Twenty–fifth day of September, in the year One Thousand Eight Hundred and Forty Three, confirmed by the said Tithe Commisioners, of which separate award the following is a copy:-

            WHEREAS AN AGREEMENT commuting the Tithes of the Parish of CHIDDINGLY, in the County of Sussex for the Rent charges in the said agreement specified has been duly made, and the said Agreement has been confirmed by the Tithe Commisioners for England and Wales, but the Apportionment of the said Rent-charges has not been confirmed.

            AND WHEREAS it hath been represented to the said Tithe Commissioners, that the said Rent-charges are in error, made by the said agreement to commence and become payable from the First day of October next after the date of the said agreement.

            AND WHEREAS it is the desire of both the Landowners and Titheowners of the said Parish, that the said Rent-charges should commence and become payable from the First day of October preceding the confirmation of the Apportionment of the said Rent-charges.

            AND WHEREAS I, GEORGE HAMMOND WHALLEY, have been duly appointed and sworn Assistant Tithe            Commissioner according to the provisions of the Act for the Commutation of Tithes in England and Wales, and have also been duly appointed to enquire into the said matter so complained of.

            NOW KNOW ALL MEN BY THESE PRESENTS, That I, the said GEORGE HAMMOND WHALLEY, having held meeting in the said Parish touching the matter aforesaid, of which meeting due notice was given for the information of the Landowners and Titheowners of the said Parish, and having satisfied myself of the existence of the errors so complained of,-

            DO HEREBY AWARD, that the Annual sums specified in the said agreement, by way of Rent-charge, shall commence and become payable from the First day of October preceding the confirmation of the Apportionment of the said Rent-charges.   IN WITNESS whereof, I have hereunto set my hand this Twentieth day of September, in the year of our Lord One Thousand Eight Hundred and Forty-three.

            NOW, I, JAMES HODSON, of Falmer, in the County of Sussex, Valuer, having been duly appointed Valuer to apportion the Total Sum agreed to be paid by way of Rent-charge in lieu of tithes, amongst the several Lands of the said Parish of CHIDDINGLY;

            DO hereby apportion the Rent-charge as follows:-
