In the name of God Amen the 18th day of Aprill 1671 in the 23th yeare of the raigne of our Soveraigne Lord Charles the Second by the grace of God of England Scotland France and Ireland King defender of the faith &c I John Brinckhurst of St Nicholas within the Burrough of Lewes in the County of Sussex gardner being sicke and weake in body but of sound and perfect memory (praise be given to God for the same) and knowing the uncertainty of this life on earth and being desireous to settle things in order doe make this my last Will and Testament in manner and forme followeing that is to say. First and principally I commend my soule to Allmighty God my creator assuredly believeing that it shall receive full pardon and free remission of all my sinnes and be saved by the precious death and merritts of my blessed saviour and redeemer Christ Jesus. And my body to the earth from whence it was taken to be buried in such decent and Christian manner as to my executrix hereafter named shall be thought meet and convenient. And as concerning such worldly estate as the Lord in mercy hath lent me my will and meaneing is shall be imployed and bestowed as hereafter by this my Will is expressed. And first I doe revoake renounce frustrate and make void all Wills by me formerly made and declare and appoint this my last Will and Testament. Item I give and bequeath unto my brother in law Henry Tiltman of Buxted in the County aforesaid husbandman three pounds. Item I give and bequeath unto his daughter Elizabeth Tiltman forty shillings. Item I give and bequeath unto William Tiltman, Henry Tiltman, Agnes? Tiltman, Joane Tiltman and Margarett Tiltman children of the above sd Henry Tiltman twenty shillings a peice. Item I give and bequeath unto James Brinckhurst the summe of foure pounds. Item I give and bequeath unto John Brinckhurst brother of the said James the summe of foure pounds. In case the said James Brinckhurst (who being att the publication of this Will beyond the seas) doe not returne within two yeares next after my decease my will and meaneing is that the said legacy of foure pounds soe given to him as aforesaid shall be paid by my executrix hereafter named to the said John Brinckhurst brother of the said James. Item I give unto my brother William Brinckhurst his widow foure pounds. Item I give and bequeath unto William Brinckhurst, Edward Brinckhurst and Daniel Brinckhurst brothers in law of the aforesaid James and John the summe of foure pounds a peice. Item I give unto John Bollard my brother in law and to Mary his wife each of them foure pounds a peice. Item I give and bequeath unto my cousins William Bollard, Richard Bollard, Mary Bollard and Anne Bollard children of the aforesaid John Bollard each of them foure pounds a peice. Item I give to Edward Brinckhurst sonne of my brother Edward Brinckhurst the summe of five shillings. Item I give unto Anne Brinckhurst the daughter of my cousin Edward Brinckhurst twenty shillings. Item I give to my cousin Richard Towner five shillings and to his daughter Susanna Towner twenty shillings. Item I give to my cousin Henry Paines wife five pounds. Item I give unto my cousin John Parkers wife foure pounds and to John Parker my God sonne tenne shillings and to Richard Parker sonne of the said John Parker five shillings and to my said cousin Parkers daughter five shillings. Item I give unto Mary Brinckhurst my said cousin John Brinckhursts daughter twenty shillings. All which said severall legacies as above given and bequeathed my will and meaneing is shall be paid to the said severall and respective legatees within two yeares next after my decease by my said executrix hereafter named. Item I give and bequeath unto my brother Edward Brinckhurst and Mary his wife all that part of my messuages or tennement conteyneing and now devided into two dwelling houses with the garden and premisses thereunto belonging and appertaineing scituate and being in the parish of St John Johns [sic] in Lewes in the County of Sussex aforesaid and now in the severall tenures or occupations of Richard More and BLANK Rawley or theire assignes for and dureing the terme of theire naturall lives and the life of the longest liver of them. And upon and after theire decease I give and bequeath the aforesaid two houses and gardens thereunto belonging unto Robert Brinckhurst sonne of the aforesaid Edward and his heires for ever. Item I give and bequeath unto John Brinckhurst one other sonne of the aforesaid Edward and to his heires and assignes other part of all that my messuage or tennement conteyneing one dwelling house with the garden thereunto belonging scituate lyeing and being in the said parish of St Johns aforesaid and now in the tenure or occupation of him the said John Brinckhurst or his assignes and adjoyning to the before mentioned two dwelling houses on the west part and to the church yard of St Johns aforesaid on the east. Item I give and bequeath more to the said Edward Brinckhurst and Mary his wife for and dureing the terme of theire naturall lives and the life of the longest liver of them all that parcell of ground and premisses with the appurtenances now converted into a cherry orchard and adjoyning to the said houses and gardens on the north and to a long lane there on the south and west part and now in my owne occupation which orchard I purchased with the said houses of Nicholas White. And from and after theire decease I give and bequeath the said orchard or parcell of ground unto the said John Brinckhurst and to his heires for ever. Item I give and bequeath unto the said Robert Brinckhurst and to his heires and assignes all that my parcell of a garden plott with the appurtennances lyeing in the said parish of St Michael’s in Lewes aforesaid abutting to the high way called St Martins Land towards the east. And I doe hereby give to the said Robert Brinckhurst his heires executors administrators and assignes all that peice or parcell of garden plott conteyneing by estimation fifty seaven foot in breadth and lyeing together att the lower end of the said last before mentioned garden plott and all my right title interest terme of yeares yet to come claime and demand whatsoever of me the said John Brinckhurst of in and to the said parcell or garden plott. Item I give and bequeath to Anne Brinckhurst my loveing wife and to her heires and assignes all that my messuage or tennement wherein I now live with the backside and gardens with all and singular theire appurtennances thereunto belonging or appertaineing scituate lyeing and being in Scarestreete? Hill in St Michaels in Lewes aforesaid in the said County of Sussex. Item I give and bequeath unto the said Anne Brinckhurst my loveing wife and to her heires all those outhouses stables and gardens with the appurtennances lately purchased by me the said John Brinckhurst of one Heward and others adjoyning to the house backside and gardens before given and bequeathed unto my said wife and now in my owne occupation. All the rest and residue of my personall goods chattells and personall estate whatsoever unbequeathed (my debts legacies and funerall expences being first paid and discharged) I give and bequeath unto the said Anne my loveing wife whom I make sole executrix of this my last Will. Item I make and ordaine Peter Gaid? of Seaford in the said County of Sussex gent my overseer of this my last Will and Testament and give him forty shillings as a token of my love and desire him to be assistant to my said wife in the prosecution of this my Will and granting what charges he shall be att by reason hereof he shall be repayed by my said executrix. In witnesse whereof I have hereunto sett my seale and to each sheet being two in number my hand the day and yeare above written. The marke of the above named John Brinckhurst.
