Will of John Hobeam of Warbleton

In the name of god amen, the third day of July 1591 …... being sick of body but of good and perfect remembrance thanks be to God do make and ordain my last will and testament in manner and form following

First I give and bequeath my soul into the hands of God and do trust to be saved by the blood and death and obedience of Jesus Christ and my body to the earth.

I give to the maintenance of the church of Warbleton 3s 4d

I give to the poor of the said parish 12s 8d

I give to Anne my daughter the best cow that she can choose amongst all my kine to be delivered to her upon the first day of May next after my decease

I give to William HOBEM and Henry HOBEM my two brothers each of them a twelvemonthing bullock to be delivered within one month next after my decease.

All the rest of my goods not before given or bequeathed (my debts and legacies paid) and charges about my will discharged and bringing up of my children at her cost and charge I give to Joan my wife whom I make sole executrix of this my last will and testament

And I desire and appoint Mr Willyam CHEYNEY my brothers William HOBEM and Henry HOBEM and John CRASHFIELD to be overseers of this my last will and testament and I give to Mr Willyam CHEYNEY and John CRASHFIELD to either of them 20d and they to have every one of them for every day that they shall travel about my wifes or childrens business 12d apiece.

This is the last will and testament of me the said John HOBEAM of all my copyhold land.

First I give my copyhold messuage and land in Heathfield to Willyam HOBEM my youngest son and his heirs for ever Also I will that Joane my said wife shall have all my said copyhold messuage and lands until my said son Willyam comes to his age of twenty-one years and then I will that the rent of the said lands shall be put out to the most profit for the use of son Willyam until he come to his full age of twenty-one years by my said overseers or so many of them as shall be living.

Item I will that Joane my said wife shall have two parts of three parts of all my freehold messuage and lands which I bought of John ?ELLIS/ELLIARD of Warbleton toward the payment of £10 to Anne my said daughter upon she cometh to the age of twenty-two years and towards her …….. and the bringing up of my said children until my son John come to his age of twenty-one years.

Item I will that if Joane my wife shall depart this present life before my sons come to their several ages of one and twenty years then I will that immediately after her decease my said overseers or so many of them as shall be living shall take my said lands into their hands to the profit of my said children until &c. Also I will that if my wife shall be minded to marry with any man before my sons come to their several ages of twenty-one years that he with whom she is minded to marry shall enter into sufficient bonds before marriage to my overseers or so many &c as well for the bringing up of my said children as for the payment of the legacies and profit aforesaid/abovesaid But if he with who she is minded to marry shall not enter into bonds as abovesaid item I will that my said overseers or so many &c shall take all my said lands and tenements into their hands to the use of my said children.

Item I will that my wife shall cause this my last will and testament to be proved before the ordinary or his deputy within six months next after my decease. If she shall not prove my said will as above-said then my will is that my overseers shall prove my said will to the use of my said children and my wife shall have the now commodity by this my said will.
